Terms of Service — Photoflexia

1. Acceptance of Terms

By accessing or using Photoflexia ("the Service"), you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

Photoflexia is an AI-powered image generation service that creates photorealistic lifestyle photos by combining your uploaded face photo with AI-generated scenes. Generated images are produced using third-party AI models.

3. Accounts

You must be at least 13 years old to create an account.
You are responsible for maintaining the security of your account credentials.
You are responsible for all activity that occurs under your account.
You must provide accurate information when registering.
One person may not maintain more than one account.

4. Subscriptions & Billing

Access to generation features requires a paid subscription.
Subscriptions are billed in advance on a recurring basis (weekly, monthly, or annually depending on your plan).
All payments are processed securely by Dodo Payments. Your payment details are never stored on this service.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you retain access until then.
Refunds are not provided for partial billing periods, except where required by applicable law.
Pricing may change with reasonable notice. Changes take effect at your next renewal.

5. Acceptable Use

You agree not to use the Service to:

Upload photos of other people without their explicit consent
Generate images that are sexually explicit, pornographic, or involve minors
Create content that depicts real people in defamatory, harassing, or misleading ways
Produce content that incites violence, hatred, or discrimination
Circumvent, disable, or interfere with the Service's security features
Use automated tools, bots, or scripts to access the Service in violation of these Terms
Resell, sublicense, or redistribute access to the Service
Violate any applicable local, state, national, or international law

Accounts that violate these rules may be suspended or terminated without refund.

6. Content & Intellectual Property

Your Content

You retain ownership of the face photos you upload. By uploading them, you grant a limited license to process them solely for generating your requested images.

Generated Images

Generated images are provided to you for personal and commercial use, subject to any restrictions imposed by the underlying AI model providers (Replicate, OpenAI). You are solely responsible for ensuring your use of generated images complies with all applicable laws.

Platform Content

The Photoflexia platform, interface, branding, and inspiration prompts are the property of Tapan Sharma and protected by copyright. You may not copy, reproduce, or distribute platform content without permission.

7. AI-Generated Content Disclaimer

This Service uses AI models to generate images. Results may vary and specific outcomes cannot be guaranteed. Generated images are creative outputs and should not be represented as authentic photographs. You are solely responsible for how you use or share generated images.

8. Privacy

Your use of the Service is also governed by the Privacy Policy, which is incorporated into these Terms by reference.

9. Limitation of Liability

To the maximum extent permitted by law, Tapan Sharma shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Total liability for any claims arising from these Terms or use of the Service shall not exceed the amount you paid in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Tapan Sharma from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms or misuse of the Service.

11. Service Availability

I strive for high availability but cannot guarantee uninterrupted access. I may modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

12. Termination

You may close your account at any time from your profile settings. Accounts may be suspended or terminated for violations of these Terms. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms are governed by applicable law, without regard to conflict of law principles.

14. Changes to Terms

These Terms may be updated periodically. Material changes will be communicated via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
